My wife's EAD expires 10/10/08, she is currently on H4 but we filed last july and got our EAD/AP. I am planning to send her to india in May and she'll be back in November around 4th (AP expires Nov 19th).
Please help me with info on these questions?
1. Does she have to be in USA to apply for EAD renewal?
2. Can she apply for EAD renewal in May (5 months in advance), I know AP cant be applied before 4 months but dont know about this EAD.
3. Or Can EAD be applied after it expires also, if yes till howlong after it expires?
4. Also she'll come back on 4th Nov and applies for AP immediately, is this OK if she applies before expiry date of Nov 19th but doesn't get the approval? (I know that she cant travel until she has a visa in passport or AP again)
Thank you guys in advance.

USCIS reports that 1000 H-1Bs were receipted over the past week with 34,500 now counted. 400 masters cap cases were added bringing the total to 13,000 in that category. if your used to the easy layout of cinema 3d (like me) then stick to it cause its alot easyer to use that 3d studio max then when you get more used to 3d design then you should maybe choose to start using 3d studio max.

Hi,
My wife is on H1B and she couldnt work for the past 6 months. I applied for my I 140 and I 485 during the July fiasco last year and she was not added as my spouse and we got married at a later date.
Since she didnt receive pay for 6 months, I guess she is out of status for these 6 months. So my question is will this have any effect on her GC process when I add her as my spouse to the I 485 application whenever my priority date become current ? I am really worried and dont want to screw up my GC process after a long wait.

Six years of Republican control in Washington have taken a toll on the country -- and the GOP is paying the price politically. Instead of the Bush administration ushering in a new era of GOP dominance, as Karl Rove hoped, it has set the stage for a Democratic resurgence.
That turnabout was implicit in the results of the 2006 midterm election, when Democrats took back narrow majorities in the House and Senate and captured the majority of governorships. And it is reinforced by a massive poll released last week by Andrew Kohut and the Pew Research Center for the People and the Press.
The survey of 2,007 people, conducted in December and January, depicts a dramatic shift in Americans' attitudes, opinions and values between 1994, when Republicans took control of Congress, and now. Most of the change has occurred since George Bush took office in 2001.
The poll, which can be found at http://www.people-press.org, is a treasure trove of information about Americans' views of the parties, government, the world scene, religion, the economy, business, labor and a dozen other topics.
But a word of caution is in order. There is little here that suggests voters' opinion of Democrats is much higher than it was when they lost Congress in 1994. It seems doubtful that Democrats can help themselves a great deal just by tearing down an already discredited Republican administration with more investigations such as the current attack on the Justice Department and White House over the firings of eight U.S. attorneys.
At some point, Democrats have to give people something to vote for. People already know what they're against -- the Republicans.

I was wondering how many people really got the opportunity to use the reinstated PPS service for I-140 petition? Has it been useful to the most of people who are stuck in the I-140 backlogs for more than year now or has it only helped a tiny segment of the folks who really needed it to maintain their status?
What is the purpose of USCIS reinstating this PPS if it only helps only very few people. I think its time, USCIS either process the pending applications soon or reinstate PPS for everyone. 1 year is a long time to wait for an I-140 approval when USCIS can re-allocate the staff at quick notice (like those folks who received EADs in two weeks during June 08) if they want to. Its high time USCIS address this issue and get us out of this mess. Visa numbers does not have to be available to process I-140..so there is no reason for them to delay or give excuses.

Current status L1A, exp 9/5/08 (family on L2)
Pending: I-140 EB1C, RD 3/5/07, still no news from Nebraska
Fact: My family members MUST travel to Europe this summer.
Fact: My extension I-129 for a renewed L1A must be submitted to USCIS no later than 6 weeks before 9/5/08.
Fact: I have L1A visa stamp and family have L2 visa stamps with expiration date 9/5/08 in our passports
Question:
How late is the latest my family members can enter US without encountering trouble at the border?
They need to be present in the US to submit the I-539 (extension of stay), but can it be submitted AFTER my I-129 or MUST they be submitted at the same time as an absolute rule?
Please advise.

So this may be the last week of H1B visa filings, as of November 27, 2009, approximately 58,900 H-1B cap-subject petitions had been filed. USCIS has approved sufficient H-1B petitions for aliens with advanced degrees to meet the exemption of 20,000 from the fiscal year 2010 cap. Any H-1B petitions filed on behalf of an alien with an advanced degree will now count toward the general H-1B cap of 65,000. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

I want to change my employer from A to B. B has filled for h1b transfer on 26-sept-2007 (I have fedex tracking number). Till today (9-oct-2007) we hv not received the receipt notice.
My expected start date was 1-oct which has been extended twice, i.e 8th & then 15th. If receipt does not come will 15th, then can I join the new employer?
Is there any way I can find out the file position/status using fedex tracking number?
Can new employer file one more application for h1 transfer under premium process?

Encouraging. Darryl Issa, the powerful new GOP House Oversight Committee Chair, has introduced this bill in the past, but with the change in party control, he's got a lot more clout this time around. Issa is proposing replacing the green card lottery's annual green card allotment with a new green card category for US-educated graduates in the science, technology, math and engineering fields. I am on L1 visa since May 10, and have plans to switch to H1 without going back to India. My employer is not ready to provide experience and relieving letters, if I dont resign and I cant resign, since I need to pay 5000$.
1) So, does it make a problem while applying for GC, If I dont have these letters from present employer.
2) Inlcuding present company's experience only , I will be able to qualify for EB2 category. But I will not be having letters from my present employer to show that I am having 5 years experience.
Is it must to have experience and reliving letters from all my employers? What are the options for me now? :confused:
