I have a question about filling out this section: PART 4, Processing Information. I am the employer and applying for a current H-1B holder (currently with another company) to transfer to my company AND extend his stay. He is currently here in the US.
Some people tell me I don't have to fill this section in, however the instructions say "if beneficiary...is outside the usa OR a requested extension of stay...cannot be granted, state US consulate or inspection facility you want notified".
What address should I put/consulate should I use (H-1B holder is from India).
Questions: 1) do i have to fill in all 1.a,b, c, and d?
2) does it matter if i check off consulate, pre-flight inspection, or port of entry?
3) if beneficiary doesn't have a fixed address in India anymore can I leave it blank?

Immigration lawmakers try to pick winners and losers. The problem is that just like a broken analog clock with its hands frozen in place, the timing is mostly wrong. Hello Forum Members -
My company has applied for my 8th year extension (3 years) based on my LC and I-140 that was applied in CA. (My LC and I-140 have been approved). But during my 7th year, I moved to NC state with the same company/department. The LCA for the extension includes both CA nad NC work locations and NC residence address.
Will there be a problem with extending the H1 using the I-140 that has been approved for CA? Will USCIS question why I am in NC when the I-140 shows a CA Address?
Please let me know your opinion.

You can keep extending the H1-B till your Green card is approved.

This is related to the experience letter and PERM.
I have been working with my current employer for last 3 years in software engineering role. Now I'm planning to move to program management role and planning to apply PERM from this new role.
1. To get experience letter for PERM, can I use the experience gained in my current company. What are the chances of AUDIT if I do so?
2. With my previous employer (3 yrs back) I worked in software and consulting role. Does this experience suffice for my PERM in program management role...Is it something the lawyer has to worry and not me..

A piece of good news on immigration was largely overshadowed by the Arizona mess. Republican Senator Richard Lugar of Indiana and Democrat Dick Durbin sent a letter to DHS Secretary Napolitano urging her to stop the deportations of students who might be eligible for relief if the DREAM Act or comprehensive immigration reform should pass. DREAM would allow some who entered the US as children to obtain permanent residency if they attend college or join the military. No word yet on how Napolitano reacted.

Hi
I have started(with a couple of friends) a non profit (University Alumuni association ) recently . Will it affect my GC processing in terms of queries or delays . I had agreed(verbally) to become the financial officer in the company (but have not made any written commitments till now ). The company is registered at my residence address by my friend and collegue although I have not signed any papers and made no financial transactions till date .
Please advice as soon as possible as i need to make sure that the tax return (deadline 15th May is also met with ) and I can get out of the picture if needed.

I used to fedex EAD and AP applications etc to this Augustine Road address before. After introducing lock boxes, they changes the fedex address too.I am planning to submit AC21. As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.
