In compliance with the precautionary measures and the travel health warning issued by the Department of State, the U.S. Consulate in Ciudad Juarez is canceling all immigrant visa and waiver appointments from April 30, 2009, through May 8, 2009. Individuals with immigrant visa appointments scheduled during this time will receive a letter with the rescheduled appointment date. Individuals with a scheduled waiver appointment will be contacted via e-mail or phone regarding the rescheduling.
Additionally, appointments for non-immigrant visas that were scheduled between April 29, 2009, through May 5, 2009, will be rescheduled. Applicants will be contacted by the call center via e-mail or phone. Additional information is available at the Ciudad Juarez Web site (http://ciudadjuarez.usconsulate.gov/h1n1.html).

I am working on L1B and also have H1B (without I94) from another employer
I am filing L1B extension and H1B Change of Status at same time
Situation 1) My L1B Extensions paper with (I94) comes prior to H1B change of status paper (with I94),
which VISA will be applicable to me and my dependent spouse
Situation 2) My L1B Extensions paper with (I94) comes after H1B change of status paper (with I94),

Attorneys please advice on my case below....
I applied for an I-485 during July Fiasco under EB3 category with an approved I-140(EB3). EB3 priority date is October 2005.
I also started another process later in EB2 category with same employer. My EB2 I-140 finally got approved recently and successfully porting the priority date from EB3 but did not file for I-485 in Eb2 yet.
Last week, my EB3 I-485 petition got approved even though my EB3 prority date is not current. I have got my welcome letter (I-797C) today. The COA is 26 on the notice.
My questions are:
Is it approved by error?
What are the risks involved for now and down the road.
Can we travel outside United States using this GC.
Will appreciate any advice.

I have an I-485 that will be current soon, but I am not employed. If they approve it, will that be considered a mistake and make it invalid? Should I withdraw it? Will a letter explaining the situation be sufficient? I have another application as a dependent, just takes longer.
Are you serious? Wait until your date become current and until then do not do anything. Instead of looking for ways to withdraw your I-485, why dont you look for ways to find a job that matches your I-140 skills, so that you can use AC21 portability.
You will never know when will you get your chance to file 485 again if you withdrew it.

TSC 485 processing date says Aug 17,2007.
Does it mean, they reviewed almost all cases before Aug 16,2007?
My receipt date is Aug 13,2007. Notice date is Oct 10,2007.
So wondering whether they touched my case or still not?
Means, they reviewd all cases wherever the VISA dates were allocated/available. As you are from India, you have thousands of cases ahead of you.

I recently got my EAD card. I intent to continue to work full time with my current employer. I want to work part time with another employer. My H1 is stamped and valid untill end of 2008.
If I use my EAD card for part-time job, does my H1 get invalid?
If yes, do I need to inform my fulltime employer about change in status?
If no, can I travel outside USA with the H1 visa for reentry?
Please help.

If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

The DS-160 form will combine the previous forms DS-156 and DS-157 and 158. Candidates already in the US may, if they are on a non-immigrant visa (such as a B1/B2 visit visa), be able to apply to the BCIS for adjustment (if changing to immigrant) or change (if changing to other non-immigrant) of status while remaining in the US. This option is not open to candidates who are present in the US under the visa-waiver scheme. Also, if the candidate did not advise of the possibility of a change of status to the relevant US Embassy or Consulate beforehand, USCIS may be reluctant to permit an application for adjustment of status.

Hi,
I had applied for GC through my husband s employer for EB1 category. Recently USCIS websites has updated on its site regarding our case that I485 has been approved but I765 has been denied. Currently we are on L1/L2 visa. Has anyone faced such a situation? And what does this signify?

As i understand it it may take upto 6 mons and may even take upto a year. Is that a safe bet? to I am planning on a vacation in Dec and i hate to be in limbo. My wife's I-140 has been approved and we are in the worldwide category.
So what do you guys think, should i just go ahead and book the tickets now or should i wait to see what happens in Oct? I would like your opinions however contrary :D
