My girlfriend (from Russia) and I have been for about 3 years and living together for the last year and I've recently decided I want to propose this summer. She is currently here as an I-9 form (she's in grad school), but her student visa is expired. She recently got a job on campus and while she was going through the paperwork yesterday realized that her passport is going to expire next April (2012). So she is now planning to go back to Russia at the end of the year to renew her passport and apply for a new student visa. As I think we'd both like a longer engagement, and with a fiance visa you need to marry within 90 days of entering the country, we probably wouldn't want to apply for one at that time. However, I'm now wondering if being engaged will cause any complications for her when applying for her student visa. Any information or advise you could give would be greatly appreciated. Thanks!

Q. Will the payment I receive in 2008 reduce my 2008 refund or increase the amount I owe for 2008?
A. No, the Stimulus Payment will not reduce your refund or increase the amount you owe when you file your 2008 return.

If you go to the USCIS website (www.uscis.gov) you can download the EAD application and the list of documents that you are required to submit. My understanding is that the location where you file your EAD is dependent on the State where you live. The EAd application instructions include information on where to file depending on the State where you live.

I need a clarification on EAD card usage. If your spouse whio has an independent H1B visa and whose 485 and EAD application is dependent on you, changes the work status from H1B to EAD, then does the status of the primary applicant also change to EAD automatically. Since the spouse's application was not independent filed and was a dependent on the original applicant for both 485 and EAD applications. I want make sure that the primary applicant's status ( separate independent H1B ) is not changed from H1B to EAD, just because of the spouse starting to use the EAD ( who is a dependent filer on primary applicant for both AOS and EAD ). Would appreciate your inputs.

I am currently out of US but working for same company in Europe
I have approved 140, but waiting for PD to be current - (Jan/03, EB3-I).
I am now a sr manager and seem to be eligible for EB1C (if company agrees).
Option 1)
- continue to stay in Europe and apply for 140 (eb1c)+CP
- while waiting for 140 approval, am i eligible for: EAD and AC21 (after 180 days)
Option 2)
-move to US on L1 visa and apply for 140 (eb1c) + 485
Option 3)
- wait for PD for eb3 application to be current
Hope the above makes sense.
Can you pls suggest the best option & approx 'how much time' it will take for option 1 & 2. (understand option 3 is unpredictable).

It is better to wait to switch after your I-140 approval ....
If you switch before, your employer could cancel the application or might not answer RFE if one is issued ...

Do you need to submit copies of your approved LC or I-140 to support your stay beyond 6 years? I don't see it mentioned in the I-129 application.
And do you say yes or no to the following question (Q.5, Part C of H-1B Data Collection and Filing Fee Exemption Supplement form)?
"Has the beneficiary of this petition been previously granted status as an H1-B nonimmigrant in the past 6 years and not left the United States for more than one year after attaining such status?"
This probably wishes to know whether you have a reason to stay here for more than 6 years. But I don't see anywhere to explain that. Any help is greatly appreciated.

No that's not the case, there are stringent reqmts for proof of Date of Birth. Passport is not one of them...

Just Ask her to redo the I-9 Employment Verification form and submit to the Employer. Nothing else needed.
