Has anyone seen today's Fox News "The Journal Edition Report". In the last-section of the this programme the journalists talk about this week's "hits and misses". One of the journalist was talking about the injustice done to LEGAL immigrants because of latest visa bulletin stuff.

I have a quick question. Should I go ahead and apply for my wife's I131 – Advanced payroll too with her 485/EAD. The way I understand 485/EAD/AP is as soon as she gets her EAD, she would want to work and in that case it would be recommended to have a AP too. People suggest that AP should/can be applied later on but I do not see any benefit in saving 6 months/170$.
Also let me add that my wife will be in US from August 10th to August 26th and then November 10th. As you have to be in country till AP approval should i defer applying her AP now. She is currently on H4.
Please suggest.

One thing is clear just lecturing members to go meet up with the lawmakers is NOT working. IV needs to come up with some fresh ideas, I mean, we all need to come up with new ideas.
Lets start brainstorming again. Here is a start
1. Some how IV meets with the president or his staff and requests visa recapture an interim fix. Ask for visa lottery numbers to be allocated to EB numbers for 3 years
Ask for relaxation in rules for changing jobs.
2. Run full page or a big advertisement in a national daily asking for the above. I am sure people will contribute if IV takes initiative.
3. Get USCIS working on our FOIA request asap. Complain to the president about it.
4. Legal action

I have heard in the past from core team and other senior members that
we have to bank on CIR for now, and if it is dead SKIL etc become an option.
The one problem with this might be "how and when would we know CIR is dead, and would it be too late to push for SKIL at that point?".
I understand this is a highly speculative question, but am hoping someone from core can articulate what our game plan regarding contingencies are.
(If this is something you can't answer on the webpage, I can understand the reasons for keeping the gameplan under wraps from our adversaries).

This is the latest update as of Tuesday, April 6, 2010, Vermont Service Center, as of close of business on Monday, April 5, 2010, VSC had received a total of 9,525 cap-subject H-1B petitions. Of those petitions, 6,791 were "regular" cap, and 2,734 were advanced degree. All cases received before April 7, 2010, will have an April 7, 2010 receipt date. Those received on April 7, 2010 or later will bear the actual receipt date. For those submitted for Premium Processing, the clock will start on April 7, 2010. yes. its possible. i had my 140 denied and i wanted to know everything about my case from labor to 140denial to appeals. I filed FOIA and USCIS sent me everything on a CD.

My employer was planning on sponsoring me, and paying all the filing fees, but the deal was that I was going to pay the lawyer directly for the legal fees. I just found out from a second lawyer that technically we can't do that because it will drop my salary below the prevailing wage. Is there anything I can do to get around this, and still pay the legal fees? Is it completely against the law for me to pay them or is that just an "interpretation of the law"? The other possibility is my husband could pay the fees, but I don't know if that's allowed either.

AC21 is the only light at the end of the tunnel for doing such things. If you change employer before I-485 is filed and pending 180 days, all you will get will be your labor priority date. You will have to file labor and I-140 again with your new employer and when filing I-485 you can use your old priority date.

Hi,
My wife has a stamped H4 visa & I-94 both are valid through Oct 16th 2008. We have applied H1B for her which got approved somewhere in May 2007.
The Approved H1B documents along with new I-94 is with her employer.
We have some issues with the employer so we are not sure that we can get the H1B & I-94 documents from her employer.
As we also applied for EAD,In the mean time if we receive her EAD card and Travel Document for my wife.
Do we still need her H1B and new I-94 documents from her employer for any reason?
Any advise is well appreciated.

We received letter from USCIS NSC saying that our AP (incl. my spouse) were approved on 10/15/08. On 11/17/08 we received RFE on my spouse AP application for photos. My wife had already left for India (11/15/08) assuming that our AP was approved. Anyways.
My question - If NSC approves her AP application (again), which date will she have on her approved AP application (i.e will the date be still 10/15/08 OR after the RFE response for photos). Photos were received at the NSC on 11/26/08.
Is anyone in the same situation. Your input is much appreciated.
