My previous employer filed EB2 labor for me. I left the job after getting 140 approved so that I will hold the priority date.
The new employer, as per their policy is planning to file labor application in EB3 category and NOT in EB2 category.
My question is, the way I post PD from old approved 140, do I port the EB2 category also? ie will my PD get compared with EB2 PD or EB3 PD when it comes to filing 485?

Hi, Im a pediatritian from Venezuela. I was hired by a research institution to work for a year here in the US, and i was granted a H1b non clinical Visa about 3 months ago. A month ago I was offered a position on the fellowship program of Pediatric Critical Care at the same institution but they need to change my visa to a Clinical H1b visa. I went to all the process here in the US. I havent go to Venezuela to get my passport stamped but at the International Depatment of the Institution they told me that i can Travel to Mexico or Canada for less than 30 days without my passport stamped, no problem. I have plans to go to Mexico for Christmas. Now my question is:
Can I travel to Mexico with my first H1b visa aprooval while my other H1b visa is on process?

Hello,
I have just got my green card and I am filling out I-130 form for my older son who was 21 when I submitted my I-140.
My question goes to point 16, "Has your relative ever been under immigration proceedings?" as I am not sure what to check over not knowing the terms (Removal, Exclusion/Deportation, Rescission and Judicial Proceedings).
I am asking that as my son has been denied admission in the US last summer. He had an F-1 visa (through 2014) but changed schools, got another I-20, went to the US Embassy in my country, the Embassy denied him a new F-1 visa but they didn't stamp with "Cancelled" the F-1 visa in his passport so he thought the visa is still valid, returned to the US but in airport he was not admitted entrance and had to fly back to our country.
Sorry for my long explanation I just want to find out if what happened to him falls under one of the 4 Immigration proceedings under article 16 in I-130 form.
I want to get him here not have him banned for ever for not knowing correctly the terms.

Maybe few visas might get rejected because they would have tried to stay in USA permanently. Yes, you may apply for L1 visa extension using Form I-129, and L Supplement. Extensions of two years at a time may be allowed until you have been in the U.S. for a total of seven years if you are a manager or executive.

We (my wife and I) applied for our EAD renewals. I got email 2 days back saying 'Card production ordered', but did not get a similar mail for my wife.
Is it normal to have applicant and dependent's timings for approvals on different dates? I was thikinkg that since we applied on the same date, and since my case is renewed, my wife's should also be renewed at the same time. Can I wait more or is this something a cause of concern?
Any suggestions please

I work for company A in india which has a subsidary company "B" in US.
On "B"'s request i worked in US for company B from July 2006 to Nov 2006 (for which i have valid pay checks).
I went back to India and worked for A till June and i came to US again to work for Company B.
Now as soon as i entered US, i have applied for a premium H1 company transfer to Company C.
Now i got a query to submit my Pay checks which i do not have as i resigned Company B after coming to US.
Please suggest me whats the ideal way to answer this query...

I've approved H1 until Apr 2011 (expired stamping in the passport) and also have EAD (I applied 485 when my family was out of country, my mistake). But as my family don't have their 485 applied, I have to be on H1. Now my confusion is when I travel out of country can I use AP to re-enter or I have to use H1 only as my family is on H4?

Sorry for posting this question again. but since I did not get an answer, I am posting again to see if some one can advise regarding this. I am trying to look up dates for H1 visa stamping in Canada and the website says no appointments for 6 weeks. I am thinking of going for visa stamping in July. is there any chance that they might open up some more appointments in the next few days even though it says unavailable currently? please post your comments and experiences regarding this.

I have applied for family based GC above 21 yrs old on December 2006 and also currently holding h1 valid from October 2008. I also have my opt till May. Now since my employer was not able to find me a project he wants me to chg my status. I do not know what to do and how to chg my visa as, if I go on student visa I need to show financial documents and since I have not made any money how is it possible . If you can also suggest some schools who will not charge much or some courses which are not very expensive and time consuming and also where I can get work authorization as I will find jobs which are not technical and in line with my educational and work qualification . I have a deadline this evening as my employer just called me and told me this

But our attorney did not file for EAD/AP, because of time constraints.
Is it ok for her to start working using the H1 from Oct 1st?

I am on my 7th year H1B, valid until next year.
My labor was approved Oct,2007 under EB3 (all education from India).
I-140 was applied in May, 2008 and it has been a frustrating 2+ yrs since I have heard anything. Attorney inquired with the USCIS and got a response that it is still under review.
This delay seems to be very unusual. Do you think this delay is due to my education from India only. I have seen folks with Master's degree from US gettting I-140 in 2 - 6 months max. I am worried that this may turn into a denial.
Anyone has similar experiences with education only from India.? Any advice if I should go for I-140 premium processing or wait ?

I think if you are out of the country for 1 year u can get 3 yr extension. But you would get counted in the quota though,fresh H1, I think.
