Not to many immigration lawyers have their books reviewed by Oprah Winfrey, but Colombian-born Iris Gomez has. That's probably because she's written the hot-selling novel "Try to Remember" about a teenage teenage Colombian immigrants struggles in her new country. Is it true that if you are on H4 visa and you are using Ead ...and your I-485 is denied...this invalidates your H4 status and you have to leave U.S?
I know that this situation applies only for H1B holder, not H4, the dependent.
If I'm out of H4 status...what are my options? How can I go back to H4 status?
Please advice....this is vey important for me.

Opponents of health care reform efforts have accused the President and Democrats in Congress of including millions of illegally present immigrants in proposals to expand health insurance coverage. Whether one thinks that including such individuals is good or bad, the fact is that only lawfully present immigrants will be eligible for inclusion in the various proposals being considered in Congress. Think Progress explains in a piece refuting erroneous reporting on Lou Dobbs show (surprised?). When you hear figures like 97% of people will be covered under the broadest plans, the 3% they're talking about leaving out are undocumented immigrants.

I applied SSN 3 week back and planning to go to India for 2 months due to personnel reasons. I am not yet received my SSN.

I am using Advance parole in december to visit India. I have applied my canada PR in 2008, but I don't have stamp of PR in my passport.
Is there are any problems using AP for India visit.

As Senate Democrats were preparing to go to the mattresses over Iraq voting procedures and as Republicans threatened to stop all activity over a judicial appointment, it's worth recalling what Senate leaders were promising at the outset of the 110th Congress.
On Jan. 4, incoming Senate Majority Leader Harry Reid (D-Nev.) declared on the floor that "last November, the voters sent us a message - Democrats and Republicans. The voters are upset with Congress and the partisan gridlock. The voters want a government that focuses on their needs. The voters want change. Together, we must deliver that change."
Minutes later, Minority Leader Mitch McConnell (R-Ky.) observed that "the challenges ahead will not be met if we do nothing to overcome the partisanship that has come to characterize this body over the past several years. A culture of partisanship over principle represents a grave threat to the Senate's best tradition as a place of constructive cooperation. It undermines the spirit and the purpose of this institution. And we must do something to reverse its course."
Six months on, the Senate has devolved into a nonstop brawl. The House, where leaders made let's-work-together promises of their own, also is a cauldron of partisanship, but at least there the rules permit a majority to rule.
But together, they've been able to pass just three pieces of significant legislation - a hike in the minimum wage, expansion of stem-cell research funding and a supplemental appropriation to fund the Iraq War. Only the first was directly signed into law. The second was vetoed by President Bush. The third was vetoed then passed.
Partisan warfare and inaction on issues from health care to immigration to energy - even lobbying and ethics reform, once the top priority for this Congress - has reduced respect for the legislative branch to its lowest level ever. Respect for the presidency is not much higher.
Who's to blame? Senate Democrats accuse Senate Republicans of "obstructionism" - systematic refusal to grant unanimous consent so that bills can be voted upon. Senate Republicans blame Reid for invoking cloture to stifle full debate and the offering of amendments.
The level of rancor is escalating now because Democrats are frustrated that Republicans are insisting on a 60-vote threshold on Iraq War amendments - as though Democrats in the past have not used the 60-vote requirement when it suited them. Republicans are threatening to create procedural chaos and allow little or no action on the floor if Democrats block a single appellate court nominee.
In January, Senators of both parties gathered in the Old Senate Chamber in what McConnell described as "a small act of bipartisanship" that he hoped would lead to a restoration of the Senate's reputation. Now, perhaps, Senators should regather there and contemplate their current level of public esteem.

My I-140 PD is pending since May 1Oth, But no Approval.
The dates are Hoax, I dont know what Nebraska is doing,
the Processing says August but I am from May but no Approvals yet.

My fiancee is from Tijuana, Mexico and she has two children aged 11 and 14. They all have BCC laser visas, which allow multiple crossings into the US. I am a US citizen and live in San Diego, 25 miles from the border.
Here's my concern: her 14-yr old daughter will turn 15 on Jan 8, 2008, at which her BCC visa expires.
If my fiancee and I get married after the expiration date of her daughter's visa, and I file for the family-based adjustment of status I-485, will that affect our application process?
In other words, do my fiancee's and her children's BCC visas need to be current in order for their applications to be approved? Will the daughter's visa need to be renewed before we can move forward? :confused:

Great news! The Hatch widows bill (which removes the requirement that a couple must have been married for two years before a US citizen dies) passed and included in that bill were provisions extending the religious worker green card program and the Conrad 30 J-1 physician waiver program. Each of these programs were extended for three years. The EB-5 regional center program for immigrant investors was permanently reauthorized by the Senate yesterday. The House must agree to these amendments before they go to the President and I do not yet know whether the bill will go back to the House...

A bill has been referred to the committee and sponsored by Sen. Sessions.
Sen. Sessions is very anti-amnesty, and looks like he is pushing a bill for the legal immigrants-in-waiting. We do not yet know the contents of the bill, but hopefully by later this week, the text of the bill would be available in the library of congress.
I think given the current political environment we can get the senators and house representatives to vote in its favor.
Lets see what the actual contents of the bill are tomorrow/day-after.
