This was one one of John Kerry's Presidential campaign proposals. you saw what happened right. As the other member said it would be something very difficult to get pass by rule makers.
How about something like,
If a person has stayed in US for 10+ (or 7+years) years and has filed taxes(verified thourgh 1040s), he should be given GC. No questions asked(other than the ones the affect security of USA)

Thank you for this thread. This news has given me fresh energy to start my case one more time under EB-2 category. I just finished filing a long document for my attorney. This news has given me enough strngth to do that. My advise, I do not see any hope in EB3-I category, unless someone makes a change in existing laws. I can't complain about EB-3 either because we could file I-485 during July-07, my wife got EAD and we do not have to go to consulate every time we visit home country. When there is a will there is a way. It is hard to just sit and watch this so called BS or DOS visa bulls.

The calculations below is not to scare anyone but it may very well a reality. Based on the assumptions below, some people may have to wait up to 20 months to get a EAD card: Ouch!
A Total I-485 Applicants: 750000 Applicants
B Each EAD processing time: 5 Minutes
C Total processing hrs: 62500 Hours
(Calculations: AxB/60)
D Daily productive Hours: 5 Hours
(It is a government body!)
E Total Man Days (Business Days): 12500 Man Days
(Calculations: C/D)
F EAD Workforce: 30 People
G Total Business Days: 417 Days
(Calculations: E/F)
H Average Business Days in a month: 21 Days
I Total Clearing Time : 20 Months

So what are trying to prove ? Generally i dont respond but this just shows that you have a lot of time. Why dampen people's spirits by such post or why try to say that whatever IV has done is a waste. That is what i get from what you have posted. If you are cynical, keep it to your own self, dont start such negative threads. Dont know you and this is not a personal attack but think twice before you create such posts, because they are disheartening for many (including me) who are so frustrated that they can believe any thing negative. not every h1 guy can or will apply for GC. For example many of this big indian IT companies, with lot of H1s in hand, either dont apply GC for employees or they have very strict policies so that most dont qualify.
I know for sure , coz i am a victims of such situation :)
many of those H1s (>50% in cases I have come across) jump to a US company here and start their GC here.

ind_game, just a heads up : when the 485 is reopened they take the op'ty to review the app for all supporting docs. meaning if you have not submitted any supporting docs like birth cert etc they would issue an RFE. They did to me, back in Jul-07 i had submitted only parents affidavit but no BC or NABC. And they gave me only 30 days (i think it used be 90 days for RFE), I had hard time collecting the required info/doc in such a short time.

I am having a home loan with ICICI. I strongly recommend do not go with ICICI. They are very fast to increase variable APR. If it declines their comment was who are watching a market. In one instance all other banks reduced their VR but not ICICI. When I emailed ,they simple said we will let you know if there any changes but never reduced. In case increasee even before announcement by RBI, they increased my APR. More over If I want to repay earlier they are charging 2% penalty. so I stongly advice do not look ICICI bank for load if you want save some money. They are not right when it comes to loan. I had always difficult to change my address on my A/c

Correct me if I am wrong, ---but I thought that "This Ammendment" was attached to a defence bill. I dont think that it was the ammendment that was shot down, but the whole defence bill.

This particular Cornyn amendment (S.Amdt. 2339) offered to attach to H.R. 2669 (College Cost Reduction Act of 2007 ), but the motion was failed due to lack of 5 votes.(55 YEAS and 40 NAYs. Require 3/5 majority) HR.2669 is passed by both Senate and house and sent for conference to resolve the difference between house and senate versions and president is sure to sign the bill and thus would become the law in another few days. This amendment does not have anything to do with defence bill or with SKILL bill. Following is the actions taken by congress of HR 2669.
IF THE AMENDMENT HAD PASSED WE WOULD HAVE GOT ATLEAST 240,000 RECAPTURED, UNUSED VISAS OF PREVIOUS YEARS IN ANOTHER FEW DAYS.

Does anyone know/suggest how to handle this delay? How are Ombudsman conferences held? Are these adhoc or with a certain frequency? We need to bring this up somehow. Recent USCIS reports show varying numbers of cases processed. But no one will know about our delays of existing AP cases unless we bring this to attention through murthy/Oh firm/ombudsman...somehow?

Though I visit the forum quite often, I do not particiapte in a big way. I just read to understand the view points of others. After a lot of hesitation I took time to draft this note!
I am not sure how far my views would find acceptance, but I would like to share some of my thoughts!
1. Although I would sincerely like to give credit to the IV forum for all what they have done (and doing), I personally feel that that the days of prayer and petition are gone!
2. To achieve something concrete and tangible, atleast a minimum of 100,000 (Desis + Chinese / Filippinos if possible) should rally in Washington DC to press our case.
This alone will generate enough publicity. We can show our strength and if there is a consensus, opt for a hunger strike.History has always shown that "direct action" alone has yielded results.
3. Unlike European countries where the laws of immigration and naturalization are simple, here it is very convoluted and confusing. All laws in the USA ONLY favour the employers and the law firms. Due to this, several of us have been harassed by our employers.
4. Instead of harping on the existing archiac and immigrant unfriendly rules, we could propose something like this:
a. Provide Green Cards for all legal immigrants who have completed 8 years of continuous stay, as on say, June 1, 2010. Continuity would mean not leaving the USA for a period of 90 days at a stretch. (I have completed more than 9 years personally, but I am suggesting a time line of 8 years because H1 is valid for 6 years and L1 is for 7 years. It will certianly not acceptable for the US Government to provide GC to every H1 / L1 holder. Any period below 8 years may meet with very stiff opposition)
b. The legal immigrants with 8 + years should have a criminal free record (barring minor traffic offenses) and should have filed their tax returns
c. Citizenship status should be provided to all legal immigrants with 10+ years
Note 1 : Rules in the UK/ Europe are :
Permanent residency after 5 years of legal stay
Citizenship after 10 years of legal stay or 15 yearls of illegal stay
5.We are always getting drawn into the trap and quagmire of the existing regulations and the INS / US goverment / Law firms / Employers are enjoying the fun
Note 2: I have stated everything based on my stay in different countries and keeping in mind the interests of the immigrant community very sincerely. It is upto IV to publish this or discard this. I was not married to her when she got her green card.It is even more difficult if we wait for family based petition, so we decided to get it through EB3, which at that time the sched A was very much highlighted.I am also ff any ammendments offered but to our dismay,the battle is even more uphill.She works in ICU and she said that it is undeniably true that shortage of nurses is everywhere.Am sure our wives are also suffering just as bad.Hope none of the lawmakers have to wait in ER becasue the nurse who is suppose to look after her/him is still waiting for his visa. this American dream is just taking its toll on a lot of people.It is very frustrating.

Please stop this EB3 vs EB2 nonsense :mad:. Let us work on something all of us can agree on a) VISA recapture b) STEM exemption c) Streamlining of USCIS processing etc. Let us not open the old wounds again. We are becoming a laughing stock with this constant bickering.
